Church Safeguarding Policy Statement

District of Gouray:   St Martin de Gouray Church, Jersey

This Church has adopted the safeguarding policies and procedures of the Church of England. In particular we are committed to:

·        the safeguarding of all children, young people and vulnerable adults

·        carefully selecting and training paid and voluntary staff who might come into contact with children or vulnerable adults,

         using  the Disclosure and Barring Service amongst other tools, to check their suitability

·        responding without delay to every complaint made which suggests that an adult, child or young person may have been harmed

·        cooperating fully with the police, local authority and any other appropriate statutory body in any investigation

·        ministering appropriately to anyone, child or adult, who has experienced abuse

·        extending pastoral care to those known to have offended against children or vulnerable adults whilst ensuring that children and

         vulnerable adults are protected from them

General Data Protection Regulation (GDPR) 2018

 

1. On 25th May 2018 GDPR came into force and under the terms of the Regulation we are required to inform you about your personal data that we hold and how and by whom it can be accessed.

 

Your Personal Data - What is it?

 

2. Personal data relates to a living individual who can be identified from that data.  This includes name and address, e-mail address and contact telephone numbers.  In order to be clear about what information you are happy for us to hold, we will make available a consent form which we request is completed and returned to the Data Controller.  If you are in a position of leadership within the church, we may display a picture to help others identify you.

3. As Vicar, the Reverend Jeff Wattley is the Data Controller (contact details below) supported by the Church Wardens, Katie Dunn and Jennie Jewell.  This means they decide how your personal data is processed.

 

How do we Process your Personal Data?

 

4. The Data Controller complies with GDPR requirements by ensuring that we keep personal data up to date; by storing and destroying data securely; by not collecting or retaining excessive amounts of data; by protecting personal data from loss, misuse, unauthorised access and disclosure and by ensuring that appropriate technical measures are in place to protect personal data.

 

5. The ways in which we might use your personal data include:

 

  • Enabling us to provide a voluntary services for the benefit of the congregation of St Martin de Gouray Church.

  • Administering membership records;

  • Fundraising and promoting the interests of the church;

  • Managing our employees and volunteers;

  • Maitaining our own accounts and records

  • Informing you of Church news, events, and activities and services running at St Martin de Gouray;

  • And, when applicable/relevant, sharing data with the Deanery or Diocese

 

 

What is the Legal Basis for processing your Personal Data?

 

6. Providing we have your consent we can keep and use your data in order to keep you informed about news, events, activities and services, or process your covenanted or one-off gifts to reclaim the tax paid on them.

7. We can keep data if processing it is necessary to carry out our obligations under Employment, Social Security or Social Protection Laws, or a collective agreement:

 

  • If processing is necessary for us to perform a task in the public interest, or for the church’s official functions and the task, or function has a clear basis in law;

  • If processing is necessary for the legitimate interests of the Church, or of a third party - unless there is a good reason to protect your data that overrides those legitimate interests.

 

 

Sharing your Personal Data.

 

8. Your personal data will be treated as strictly confidential and will only be shared with other members of the church in order to carry out a service to other church members or for purposes connected with the church. We will not share your data with third parties outside of the church without your consent.

 

How long do we Keep Your Personal Data?

 

9. We keep data in accordance with the guidance set out in the guide ‘Keep or Bin: Care of Your Parish Records’, which is available from the Church of England website[1].

 

10. Specifically, we retain electoral roll data while it is still current; gift aid declarations and associated paperwork for up to 10 years after the calendar year to which they relate; and parish registers (baptisms, marriages, funerals) permanently as is legally required.

11. Unless subject to an exemption under the GDPR, you have the following rights with respect to your personal data:

 

  • To be informed about the collection and use of your personal data;

  • To access your personal data;

  • The right to have inaccurate personal data rectified or completed if it is incomplete;

  • To have personal data erased – commonly known as “the right to be forgotten”;

  • To request the restriction or suppression of your personal data;

  • To obtain and reuse your personal data for your own purposes across different services;

  • To object to the processing of personal data in certain circumstances;

12. If we wish to use your personal data for a new purpose, not covered by this Data Protection Notice, we will provide you with a new notice explaining this new use prior to commencing the processing and setting out the relevant purposes and processing conditions. Where and whenever necessary, we will seek your prior consent to the new processing.
